Increase in retirement funds, 401K, gains in property value are considered marital property and without a prenuptial contract, state law will determine the division of such assets.

Statistically, 33% of all first marriages and 50% of second and third marriages conclude in divorce. Through a prenuptial agreement, a couple can write their own detailed rules and definitions of "marital" and "separate" property, and protect and control distribution of their own assets should their marriage take that route.
