A prenuptial agreement or a prenup is a contract entered into prior to marriage or a civil union where the couple states how they will divide assets, property, income, and financial expenses in the event of divorce or death. The contract determines the level of alimony or spousal support owed post divorce. Income gained during the period of marriage is considered "marital property." Increase in retirement funds, 401K, gains in property value are considered marital property and without a prenuptial contract, state law will determine the division of such assets.
Statistically, 33% of all first marriages and 50% of second and third marriages conclude in divorce.
