Many divorces are resolved through mediation to avoid the costs and stress of litigation, and a court may order counseling and mediation for parties to try to resolve their divorce issues. If the parties are able to resolve their differences, a legally enforceable settlement agreement, detailing the divorce resolutions, will be signed by each party. If the parties are unable to reach an agreement, the case will proceed to trial. At trial, each party will be given the opportunity to tell their side of the marital story to the judge. Evidence can be presented and witnesses may be called. After all the evidence has been heard and each party has had the opportunity to present their case, the court will resolve all of the divorce issues, such as property distribution, child custody and visitation, and child support. Once a dissolution decree has been entered, an unsatisfied party may appeal the judge's rulings. A party may also later petition for modification of provisions of the decree if there has been a post-marital change in circumstances.
