Types of Adoption

In Indiana, the following parties must consent to adoption:

  • Each living parent of a child born to married parents
  • The unwed mother and the father whose paternity has been established
  • Any person or agency having custody
  • The court having jurisdiction
  • A minor parent with the concurrence of the parent or guardian
  • The spouse of a married parent
  • An adoptee who is 14 years of age or older

 

Parental consent is not necessary when:

  • Parental rights have been terminated in the child's best interest
  • Parents have been declared incompetent or mentally unstable
  • Parents have been found to be unfit
  • Parent has been convicted of murder, manslaughter, or causing the suicide of the child's other parent
  • Parent has been convicted of murder, manslaughter, rape, incest, neglect, battery, or causing the suicide of the child's sibling
